Toepassing van röntgenstraling om medisch-juridische en arbeidsgeneeskundige redenen in Nederland : Een verkenning

English Abstract
Three situations have been identified in which persons are exposed to X-rays in the Netherlands for medico-legal and occupational purposes. The first is X-ray imaging of persons suspected of drug trafficking, with the aim of identifying stuffed or swallowed packages inside the body, the second of young asylum seekers to determine age by means of an assessment of skeletal maturity and the third of sports professionals when they are hired. As a rule, these exposures are applied for by a physician following a protocol, just like it is done for X-ray imaging when a medical indication does exist. It also appears that some chiropractors in the Netherlands perform radio-diagnostic exposures even though they are not legally authorized to do so. In their opinion, X-ray exposures are indispensable to their treatments and they have compiled their own guideline. These are the main results of a survey carried out by RIVM by order of the Dutch Health Inspectorate.
Application of ionising radiation can be justified if the expected benefits outweigh the risks. Therefore, the Dutch Forensic Institute has adopted an upper limit of 0.1 mSv for the dose, persons may be exposed to as a result of a medico-legal examination. This is the same as the annual maximum dose that members of the public may be exposed to outside a location where ionising radiation is applied.
When a medical indication exists, both the expected benefits of an exposure to ionising radiation and the risk apply to the same person. When the exposure is based upon other justifications, however, the weighing of risks against benefits is more complicated. This may be the case when the exposure has benefits only to society as a whole, or when it is not evident that the medical indication justifies the exposure. An example of the latter is the application of X-ray imaging by unqualified paramedics.
Legislation in the Netherlands currently recognizes five types of medical exposures: diagnostic and therapeutic medical procedures, occupational checkups, population survey programmes, volunteers to medical and biological research programmes and medico-legal procedures. In the European context, this legislation is being reviewed as part of the new Basic Safety Standards (BSS). It is possible that a number of the applications discussed here will no longer be qualified as medico-legal in the near future.

In Nederland worden in drie situaties met zekerheid personen onderzocht met röntgenstraling om een medisch-juridische of arbeidsgeneeskundige reden. De eerste betreft het maken van röntgenfoto's bij verdachten van drugssmokkel om drugsbolletjes in het lichaam te detecteren, de tweede het maken van röntgenfoto's bij alleenstaande jonge asielzoekers om te bepalen of ze minderjarig zijn en de derde het keuren van topsporters bij de aanstelling. De aanvraag voor een dergelijk röntgenonderzoek wordt vrijwel altijd volgens een protocol gedaan door een arts, zoals dat ook gebeurt wanneer er wel een medische indicatie bestaat. Daarnaast kwam naar voren dat er in Nederland chiropractoren zijn die radiodiagnostisch onderzoek uitvoeren zonder dat zij daartoe wettelijk bevoegd zijn. Zij achten röntgentechnologie in voorkomende gevallen onmisbaar voor een goede chiropractische hulpverlening en hebben een eigen richtlijn opgesteld. Dit blijkt uit een inventarisatie door het RIVM in opdracht van de Inspectie voor de Gezondheidszorg.
Toepassen van straling is te rechtvaardigen als het verwachte voordeel opweegt tegen het risico op nadelige effecten. Het Nederlands Forensisch Instituut hanteert daarom een bovengrens van 0,1 millisievert voor de dosis die personen door een medisch-juridisch onderzoek mogen ontvangen. Dit is evenveel als de hoeveelheid straling waaraan leden van de bevolking per kalenderjaar maximaal mogen worden blootgesteld vanuit en buiten een locatie waar handelingen worden verricht met radioactiviteit.
Als röntgenonderzoek plaatsvindt op medische indicatie, dan hebben het verwachte voordeel en het risico beide betrekking op dezelfde persoon. Wanneer de blootstelling echter plaatsvindt om andere redenen, is het maken van de afweging of het verwachte voordeel opweegt tegen het risico minder eenvoudig. Dit kan bijvoorbeeld komen doordat de blootstelling van een individu alleen maatschappelijke voordelen heeft, maar ook doordat er discussie is over de medische indicatie. Een voorbeeld van het laatste is het toepassen of aanvragen van radiodiagnostisch onderzoek door chiropractoren die daartoe in Nederland niet bevoegd zijn.
Een afwegingskader wordt momenteel geboden door de huidige wetgeving die de medische stralingstoepassingen onderverdeelt in diagnostische en therapeutische medische procedures, bedrijfsgeneeskundige controles, bevolkingsonderzoeksprogramma's, vrijwillige deelname aan medische en biomedische onderzoeksprogramma's en medisch-juridische procedures. In Europees verband wordt deze wetgeving momenteel herzien in het kader van nieuwe Basic Safety Standards (BSS). Mogelijk zal een aantal van de hier besproken verrichtingen in de toekomst niet langer onder de medische stralingstoepassingen vallen.
